By accessing or using the website at victorvilleasphaltpaving.com (the "Site"), or by engaging Victorville Asphalt Paving ("we," "us," or "our") for any service, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Site or our services. We reserve the right to update these terms at any time. Continued use of the Site or our services after any changes constitutes your acceptance of the revised terms.
Victorville Asphalt Paving is a licensed asphalt paving contractor serving Victorville, CA and surrounding communities. Our services include, but are not limited to, asphalt paving, sealcoating, asphalt repair, parking lot striping, driveway paving, crack sealing, pothole repair, grading and excavation, concrete curbing, asphalt milling, drainage solutions, and speed bump installation.
The Site is provided for informational purposes only and to allow prospective customers to request estimates and contact us. Use of the Site does not constitute a binding service agreement. A binding agreement is formed only when a written proposal is signed by both parties.
All estimates are provided in writing following an in-person assessment of your property. Estimates are based on the scope of work, site conditions, materials, and labor requirements observed at the time of the visit. Estimates are valid for 30 days from the date of issue unless otherwise stated in writing.
Prices are subject to change if site conditions differ materially from those observed during the estimate, if you request changes to the scope of work, or if material costs change significantly between the estimate date and the scheduled work date. We will notify you of any price changes before proceeding.
No estimate provided verbally, through the Site, or by email constitutes a binding agreement. Only a signed written proposal is binding.
Scheduling is subject to crew availability, weather conditions, and material availability. We will confirm your scheduled date in writing. We reserve the right to reschedule due to weather, equipment issues, or other circumstances outside our control. We will provide as much advance notice as possible in such cases.
If you need to cancel or reschedule, please notify us at least 48 hours before the scheduled work date. Late cancellations or no-shows may result in a cancellation fee as specified in your written proposal. If a deposit has been paid, cancellation terms will be governed by the terms stated in the signed proposal.
We reserve the right to cancel or terminate a project if site conditions are unsafe, if permits or HOA approvals required for the work are not obtained, or if payment obligations are not met.
Payment terms are set out in your signed written proposal. In general, a deposit may be required before work begins, with the remaining balance due upon completion of the project or as otherwise stated in the proposal. Acceptable payment methods will be specified in the proposal.
Payments not received by the due date may be subject to a late fee. We reserve the right to suspend or terminate work if payment obligations are not met. All returned checks or failed electronic payments may be subject to a returned payment fee.
Any disputes about invoiced amounts must be raised in writing within 7 days of receiving the invoice. Failure to raise a dispute within that period constitutes acceptance of the invoice.
We stand behind our work. If a workmanship defect is identified within the warranty period stated in your written proposal, we will return to assess and address it at no additional cost, subject to the exclusions below.
Our warranty covers defects in materials and workmanship under normal use and conditions. It does not cover damage caused by: abnormal use or traffic loads beyond those anticipated at the time of the estimate; failure by the customer to follow post-installation care instructions (including curing periods); acts of nature such as floods, earthquakes, or extreme weather events; subsurface conditions not visible or discoverable during normal site inspection; or damage caused by vehicle fluids, de-icing chemicals, or other substances not disclosed prior to the start of work.
Except for the limited workmanship warranty described above, the Site and our services are provided "as is" without warranties of any kind, express or implied, to the fullest extent permitted by applicable law.
To the fullest extent permitted by law, Victorville Asphalt Paving and its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our services, even if advised of the possibility of such damages.
Our total liability for any claim arising out of or related to our services shall not exceed the total amount you paid us for the specific project giving rise to the claim.
You agree to use the Site only for lawful purposes. You may not use the Site to transmit any content that is false, misleading, defamatory, or otherwise objectionable, or to attempt to gain unauthorized access to any portion of the Site or its related systems.
All content on the Site, including text, images, and design, is the property of Victorville Asphalt Paving or its licensors and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written permission.
If a dispute arises between you and Victorville Asphalt Paving, we encourage you to contact us first to try to resolve it informally. Most concerns can be addressed quickly with a direct conversation. Please reach out using the contact information at the bottom of this page.
If informal resolution is not possible, disputes arising from or relating to these terms or our services shall be resolved through binding arbitration in Victorville, California, in accordance with the rules of a mutually agreed arbitration provider, unless both parties agree otherwise in writing. You waive any right to participate in a class action lawsuit or class-wide arbitration with respect to any claim covered by these terms.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes not subject to arbitration shall be subject to the exclusive jurisdiction of the state and federal courts located in San Bernardino County, California.
We reserve the right to modify these Terms and Conditions at any time. When we do, we will update the effective date at the top of this page.
